1. Acceptance of Terms
By creating an account on Upgrade Already, you confirm that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you must not use the platform. These terms constitute a legally binding agreement between you and Upgrade Already.
2. Service Description
Upgrade Already is an AI-powered training platform designed for professional airline pilots preparing for command upgrade assessments. The platform generates realistic interview scenarios, evaluates responses across the 8 ICAO pilot competencies, and provides personalised feedback and coaching. The platform is a training and self-improvement tool only. It is not an official assessment, examination, or certification body. Results generated by the platform do not constitute an official evaluation and should not be relied upon as a substitute for formal assessment by your airline, regulator, or training organisation.
3. Account Registration & Eligibility
To use this platform, you must: be at least 18 years of age; be a professional airline pilot or have a legitimate professional interest in command upgrade training; provide accurate and complete registration information; maintain the security of your account credentials. You are responsible for all activity that occurs under your account. You must notify us immediately at support@upgradealready.com if you become aware of any unauthorised use of your account.
4. Subscription & Payment
Access to the platform requires a paid subscription after an initial trial period. Subscription plans (Monthly, 6-Month, and Annual) are billed in advance through our payment processor. You may cancel your subscription at any time via your account settings or billing portal. Upon cancellation, you retain access until the end of the current billing period. Refunds are handled in accordance with applicable consumer protection law. Prices may change with 30 days' prior notice to active subscribers.
5. Acceptable Use
You agree not to: share your account credentials with any other person; misrepresent your training scores or results to any third party, employer, or regulatory body; use automated tools, bots, or scripts to access the platform; attempt to reverse-engineer, decompile, or extract the AI models, prompts, or training content; upload malicious content or attempt to compromise platform security; use the platform for any purpose other than personal professional training and development.
6. Intellectual Property
All content on the platform, including AI-generated scenarios, questions, feedback, training materials, software, and design elements, is the intellectual property of Upgrade Already or its licensors. Your subscription grants you a limited, non-exclusive, non-transferable licence to access and use the platform content for personal training purposes only. You may not reproduce, distribute, modify, or create derivative works from any platform content without our prior written consent. Operations manual content processed by the platform remains the property of its respective owners.
7. AI-Generated Content Disclaimer
Training scenarios, competency assessments, scores, and feedback are generated by artificial intelligence. While we strive for accuracy and realism, AI-generated content may contain errors, inaccuracies, or scenarios that do not perfectly reflect real-world operational procedures. You should always defer to your airline's official operations manuals, SOPs, and training department guidance. Upgrade Already accepts no liability for career, employment, or operational decisions made based on AI-generated training content or scores.
8. Data Protection
Your personal data is processed in accordance with our Privacy Policy, which forms part of these Terms. By using the platform, you acknowledge that your training responses are processed by AI systems to generate scenarios, scores, and feedback. You may exercise your data protection rights, including the right to access, export, and delete your data, through your account settings at any time. 9. Limitation of Liability
To the maximum extent permitted by applicable law: Upgrade Already is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not warrant that the platform will be uninterrupted, error-free, or free from harmful components. Our total liability to you for any claim arising from your use of the platform shall not exceed the amount you paid to us in the 12 months preceding the claim. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or professional opportunities.
10. Termination
You may delete your account at any time through your account settings. Upon account deletion, all your personal data, training sessions, scores, and progress will be permanently removed in accordance with our Privacy Policy. We reserve the right to suspend or terminate your account if you breach these Terms, including but not limited to misuse of the platform, sharing account credentials, or misrepresenting AI-generated results. We will provide reasonable notice where possible before terminating an account for breach.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising from these Terms or your use of the platform shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE. Nothing in these Terms affects your statutory rights as a consumer under the laws of your country of residence.
12. International Users
Upgrade Already serves users globally. If you access the platform from outside the UAE, you are responsible for compliance with your local laws. We acknowledge and respect the data protection rights granted by: the General Data Protection Regulation (GDPR) for EEA and UK residents; the California Consumer Privacy Act (CCPA/CPRA) for California residents; the UAE Personal Data Protection Law (PDPL) for UAE residents; the Lei Geral de Proteção de Dados (LGPD) for Brazilian residents; the Personal Information Protection and Electronic Documents Act (PIPEDA) for Canadian residents; the Protection of Personal Information Act (POPIA) for South African residents. Your specific rights under each of these frameworks are detailed in our Privacy Policy.
13. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify registered users via email at least 30 days before the changes take effect, and update the "Last updated" date at the top of this page. Your continued use of the platform after the effective date of any changes constitutes acceptance of the updated Terms. If you do not agree with the updated Terms, you should stop using the platform and delete your account.
